Information pursuant to art. 13 of Regulation (EU) 2016/679 on the protection of personal data (GDPR)

Pursuant to the articles. 13 and 14 of Regulation (EU) 2016/679 (hereinafter, “GDPR”), the company AKG Italia Srl, with registered office in Corso di Porta Romana 122, Milan, as Data Controller, hereby wishes to inform you regarding the use of your personal data, provided by you to us and also acquired by third parties.

In particular, the personal data in question concern:

  • Name
  • Address or other personally identifiable information
  • Work-related data
  • Social security data
  • Study and work curriculum

AKG Italia Srl collects personal data directly from you during the hiring process. We also collect personal data about you from our service providers and agents (such as third party employment agencies (such information may include details of your qualifications and experience) and suppliers who assist us in the candidate selection process (such information may include details of particular categories of personal data).

  1. Data falling into the category of particular data

On a possible and exceptional basis, as in the case in which due to the establishment of a working relationship we become aware of the possible belonging of the interested party to the protected categories, other personal data may be acquired which fall, according to the terminology of the Law, in the category of particular data, such as those capable of revealing racial and ethnic origin, religious, philosophical or other beliefs, political opinions, membership of parties, trade unions, associations or organizations of a religious, philosophical, political or trade union nature; as well as personal data suitable for revealing the state of health and sexual life.

  1. Nature of the contribution

The provision of data is optional and is left to the will of the candidate who, without any solicitation from the Data Controller, presents his or her curriculum vitae. With regards to the data subsequently and possibly requested by the Data Controller, failure to provide it makes it impossible to proceed with the verification of the prerequisites for the selection procedures, the hiring and/or the start of the collaboration and, therefore, the possible establishment of the relationship with the Data Controller.

  1. Purpose of processing and legal basis

Your personal data is used for selection procedures, in particular, to verify the conditions for hiring and/or starting a collaboration and to follow up on the candidate’s request.

Personal data are collected and processed as necessary for the execution of pre-contractual measures adopted at the request of the interested party (art. 6 par. 1, letter b GDPR).

Any particular data present in the curricula, if they are spontaneously inserted by the candidate, are processed on the basis of consent.

  1. Methods of use of data

Personal data may be processed not only by electronic means, but also by non-automated tools, and the processing is carried out solely with operations, as well as with logic and through forms of data organization that are strictly indispensable in relation to the aforementioned obligations, tasks or purposes. .

  1. Scope of data circulation

The data may be used by the Data Controller’s personnel who have been assigned a specific role and who have been given adequate operating instructions in order to avoid loss, destruction, unauthorized access or unauthorized processing of the data. Your personal data will be made accessible only to those within the company organization who need it due to their job or hierarchical position.

Third-party companies that carry out instrumental activities on behalf of the Data Controller may also use the data; the latter act as Data Processors and under the direction and control of the Data Controller.

  1. Communication of personal data

We will not share your information with other organizations for their marketing, market research or commercial purposes.

However, we may pass on the information we collect about you:

  • Anonymously for our client.
  • If we need to disclose your personal information to any law enforcement authorities, courts, regulators, government authorities or other third parties where we believe that doing so is necessary to comply with a legal or regulatory obligation or otherwise to protect our rights or rights of any third party.
  1. Data retention times and storage methods

The data will be kept for the time necessary to fulfill the requirements for selecting the candidate and in any case no longer than 12 months after their collection, except for the possible establishment of an employment and/or collaboration relationship.

  1. Exercise of rights

You may, at any time, exercise the rights indicated below.

  • Access to personal data: obtain confirmation whether or not data concerning you is being processed and, in this case, access to the following information: the purposes, the categories of data, the recipients, the retention period, the right to propose complaint to a supervisory authority, the right to request rectification or cancellation or limitation of processing or opposition to the processing itself as well as the existence of an automated decision-making process;
  • Request for rectification or cancellation of the same or limitation of processing concerning him : “limitation” means the marking of the data stored with the aim of limiting their processing in the future;
  • Opposition to processing : object for reasons related to your particular situation to the processing of data for the execution of a task of public interest or for the pursuit of a legitimate interest of the Data Controller;
  • Data portability : in the case of automated processing carried out on the basis of consent or in execution of a contract, to receive the data concerning him in a structured, commonly used and machine-readable format;
  • Revocation of consent to processing for the aforementioned purposes : the exercise of this right does not prejudice in any way the lawfulness of the processing carried out before the revocation;
  • Propose a complaint pursuant to art. 77 GDPR to the competent supervisory authority: based on your habitual residence, place of work or place of violation of your rights; for Italy, the Guarantor for the protection of personal data is responsible and can be contacted via the contact details on the website http://www.garanteprivacy.it .

The aforementioned rights can be exercised by sending a specific request via the contact channels:

Requests relating to the exercise of rights will be processed without unjustified delay and, in any case, within one month of the request; only in cases of particular complexity and the number of requests can this deadline be extended by a further 2 (two) months.
